Plaintiff was unlawfully detained for approximately 24 hours before he was arraigned in Kings County Criminal Court on November 28, 2019 and charged with felony crimes without probable cause based upon the defendants’ false, misleading, and incomplete allegations against plaintiff. Plaintiff was remanded into DOC custody where he was unlawfully detained for approximately 1 week before he was able to post bail and was released from custody. The defendants who did not physically touch plaintiff but observed their fellow officers violating plaintiff's rights but neglected to intervene to stop their fellow officers failed to intervene. Plaintiff was subject to the negligent inflction of emotional distress by the defendants. Plaintiff lost his employment due to the arrest.
