While in the vehicle, Defendant Officers informed Plaintiff that there was no warrant and he was only wanted for questioning.  \n\nAt the precinct Plaintiff was questioned by Defendant Detective Joshua Winters, who had issued an investigation card (\"I-card\") rather than a warrant.  The Defendant Officers knew they were not acting under color of law when they unlawfully arrested Plaintiff in his residence.  Defendant Winters falsely stated that Plaintiff had been selected from a photo book and that he had arranged for the alleged victim to come in for a line-up at 1 pm.
