While present at his home, plaintiff observed his neighbor, Reyes, park her car in a manner that infringed on his property. Plaintiff took photos of the vehicle on his property and called the police. Later that day, when Plaintiff exited his home to throw out trash, Reyes screamed at plaintiff. After Reyes screamed at plaintiff, police arrived and spoke to plaintiff, then went to speak to Reyes and Orta. Police never examined where the vehicle was parked. Orta and Reyes made false allegations against plaintiff, claiming plaintiff damaged their vehicle by opening the side door of plaintiff's home into Orta's vehicle. Plaintiff never made contact with Orta's and Reyes' vehicle, confirmed by a video of the argument. After Orta's and Reyes' false statements were made, defendants were sent to arrest plaintiff. On May 11, 2017, plaintiff was arrested for criminal mischief. Plaintiff spent one day in jail. A video tape that documented the incident and demonstrated Orta's and Reyes' statements were false was ignored by the NYPD for the duration of the criminal litigation against plaintiff.
