Upon the plaintiff requesting the MTA clerk if he could get a free ride, defendant NYPD officer approached the plaintiff and asked for identification. Plaintiff explained that he forgot his wallet and began exiting the station. It was then that the defendant grabbed the plaintiff's arm as he was exiting the station and handcuffed him. At no time did the plaintiff commit a crime or violate the law prior to the arrest. The officer recovered no drugs, weapons, or other illegal contraband from the plaintiff's person. The plaintiff began having an asthma attack from the encounter, and his eyeglasses were broken when he was thrown to the ground.
