Plaintiff was alarmed and went to check on his stepdaughter before checking the front door where he was met with several police officers with their guns drawn and some were equipped with riot shields.  Plaintiff panicked and ran out into the hallway with his hands up and was immediately handcuffed and placed in his living room.  Plaintiff was not shown a warrant, and was questioned if he had flushed any drugs down the toilet and if any drugs in the apartment.  Plaintiff responded that he had a small amount of CBD and Marijuana in a duffel bag by the front door.  After which, defendants emptied the CBD and Marijuana, which are legal substances in the State of NY, into the plaintiff's fish tank. As Defendants searched the apartment, they frightened plaintiffs domestic partner, his stepdaughter and his dogs and damaged many of the plaintiff's personal effects.  Defendants destroyed a bin of pottery clay because they assumed it was cocaine but did not performed a narcotics test.  Plaintiff was placed under arrest, taken to the 101 precinct and charged with criminal possession of a controlled substance in the first degree. Plaintiff asserts Defendants confiscated belongings, monies in the amount of $546. and his cellphone.  He was placed in very tight hand and ankle cuffs  and handled roughly which caused injury.  Plaintiff was then transferred to Jamaica Hospital where he was treated in the emergency room for his injuries and asked to be an informant for the NYPD.  Prior to Plaintiffs arraignment a criminal court complaint was filed against Plaintiff accusing him of criminal possession of a controlled substance.  Plaintiff was assigned Public Defender Michael Gluck of The Legal Aid Society for representation and offered by prosecution lifetime parole in exchange for a guilty plea to the aforementioned charges. Plaintiff refused to accept a guilty plea and maintained his innocence.  Plaintiff spent one day in criminal court and 9 days in Rikers.  He was placed in Rikers on May 27th and released on June 4th 2022.  The ADA of Queens County requested the pottery clay be tested and on June 1, 2022 the result confirmed that it was not a controlled substance. Plaintiff, unaware the individuals were police officers, ran inside his property for protection and carried a nearby bookbag into the property's interior hallway. POs entered Plaintiff's property, grabbed him, and began to punch him while others held Plaintiff's face against the interior stairs. This beating resulted in multiple head bruises and blackened Plaintiff's eye. Plaintiff was handcuffed and arrested while an officer opened the bookbag and found a weapon and 1/16th ounce of marijuana. Plaintiff was brought to the 113th Precinct, where he passed out due to head injuries and was given a CAT scan. \n\nPlaintiff was indicted and charged with illegal possession of a firearm and criminal possession of marijuana. Plaintiff's attorney filed for a suppression hearing because the bookbag search violated Plaintiff's constitutional rights. At the suppression hearing POs testified despite having knowledge of the unconstitutionally obtained evidence from a warrantless search and Plaintiff, facing a substantial prison sentence, entered into a plea agreement. Plaintiff was remanded to Rikers Island's floating barge then Otis Bantum Correctional Center, where he was attacked by multiple cellmates.
