While trying to escape, the Plaintiff sought the help of NYPD officers, however, they abandoned the plaintiff saying that they were going to be delayed for another assignment. The Plaintiff was then again attacked by the robbers, his belonging were stollen, and he required emergency surgery. The NYPD refused to investigate the robbery. The Plaintiff also sought the assistance of the NYPD after his landlord physically assaulted and threatened to kill him in March 2009. The NYPD called the ambulance but took no action against the landlord. On September 9, 2010, the Department Building Inspector attempted to search the apartment and was told was violating the Plaintiffs’ due process results. The Inspector then called the NYPD and officers forced their way into the Plaintiffs apartment, strip searched the plaintiff, and kicked the plaintiff’s mother out of the apartment. The NYPD forcibly removed the Plaintiff and his mother from their place of residence without a court order, despite the fact that there was no search warrant or eviction order. While this occurred, the plaintiff and his mother were harassed and called racially charged terms. As a result, the Plaintiff was left homeless. \n\nThe New York Department of Housing Preservation and Development were supposed to provide shelter and storage to the Plaintiffs and make any needed emergency repairs while the Plaintiff and his mother were removed. However, the department did not prevent the Plaintiff’s landlord from stealing the plaintiff’s possessions. On September 24, 2010, the Plaintiff was harassed and attacked on the Staten Island Ferry Terminal in front of the NYPD, but the NYPD officer refused to arrest or investigate the perpetrator of the attack. On October 4, 2010, the Plaintiff sought the NYPD’s assistance in getting their personal belongings back from the landlord, but the responding NYPD officers, Zelieski and Zielinski, did not take any action and did not permit the Plaintiff or his mother to file a police report. On September 2, 2011, the Plaintiff responded to a Craigslist ad for an apartment for rent. He confirmed with the real estate agent that the apartment was “legal” and was located above street level, and was paid an application fee for the apartment. However, when he was shown the apartment it was located underground and the plaintiff demanded his money back. The real estate agent refused to refund the money and the plaintiff sought the NYPD’s assistance. However, the NYPD refused to assist. He also tried to flag down a police car on the street but the car refused to stop and ignored the plaintiff. After three hours, an NYPD officer came to the scene but then refused to take a report or assist the plaintiff. On October 22, 2012, the Plaintiff was attacked, called racial and homophobic slurs, and beaten by a team of people wearing law enforcement badges in Staten Island. The NYPD officers dispatched tot eh scene refused to take a report or assist the plaintiff.
