They called 911 and reported the events to NYPD Officers Messa and Assencao. The Officers proceeded to arrest Mr. Isaac, a nearby pedestrian who did not fit the physical description provided (apart from being a black male), and who was walking in the opposite direction that the man had fled. Officer Assencao fabricated an account to the ADA that he had personally observed Mr. Isaac holding the boxes, that the witnesses had directly pointed out Mr. Isaac, and other false details to support the arrest. Officer Messa and Lt. Kenny, the supervisor who authorized the arrest, did not intervene despite their knowledge that this was flase. On May 29, 2008, the owner of an adjacent warehouse noticed that one of her windows had been broken and merchandise stolen. Det. Hachadoorian was assigned to the case and incorrectly noted that the witnesses in the previous case had observed Mr. Isaac as the person who fled from the roof and that Officer Assencao had directly recovered the boxes from Mr. Isaac. Det. Buell, his supervisor, approved the inclusion of these false statements in the complaint.\n\nOn June 25, 2008, Mr. Isaac was arrested for burglary and incarcerated. At the indictment and subsequent trial, the officers involved presented false testimony and cultivated the civilian witnesses and warehouse owner to falsely testify. All officers failed to review or preserve the 911 call or radio transmissions with the initial witness description, or turn over records from the initial searches of the warehouses. After two years of pretrial detention, the court convicted Mr. Isaac and sentenced him to 3.5 to 7 years in prison in 2010.
