Defendant-officers, including Officer Brian Tarsnane (Shield No. 05534), unlawfully approached and stopped plaintiff without probable cause, valid search or arrest warrant, or any legal justification. Plaintiff politely inquired as to the pretense for the stop. Defendant officers ignored plaintiff. Defendant officers aggressively seized person about his head and body, unlawfully searched his person, clothing, and personal belongings, and physically seized plaintiff's bicycle. Defendant-officers, including Officer Tarsnane, proceeded to slam plaintiff's head and body forcefully into the ground, grabbed plaintiff, and forcefully and aggressively applied excessively tightened handcuffs. Defendant-officers ignored plaintiff's requests to loosen aforementioned handcuffs. Defendants' course of conduct was solely due to defendants' perception or consideration of plaintiff's race, ethnicity, origin, status, religion, gender, or age.\n\nDefendants transported plaintiff to the 19th NYPD Precinct. Defendants proceeded to unlawfully interrogate plaintiff without presence of counsel and without being informed of his rights under Miranda v. Arizona. Defendants, including Officer Tarsnane, signed and forwarded a criminal court complaint to the New York District Attorney's Office, in which they knowingly affirmed the truth of fabricated allegations against plaintiff. Defendants' fabricated allegations were sought to substantiate criminal offenses of possession and sale of narcotics. Subsequently, plaintiff was issued a Desk Appearance. On April 15, 2022, plaintiff was released from physical custody. Plaintiff was in defendants' physical custody for 2 days.
