Defendant officers approached Plaintiff in an unmarked car, stopped Plaintiff by signaling him with their police lights and sirens, and pulled over Plaintiff. Plaintiff lawfully pulled over and Defendants exited their vehicle, approached Plaintiff's vehicle on foot, and demanded he furnish them with his license and registration. Plaintiff stated he was not in possession of his ID and furnished Defendants with a debit card with his information listed on it. Defendants alleged they could smell the odor of marijuana, and demanded Plaintiff and the three individuals exit the vehicle. Defendants illegally searched Plaintiff's vehicle. Defendants grabbed plaintiff, accused him of criminal offense, and violently contorted his arms behind his back to affix metal handcuffs to Plaintiff's wrists in an excessively tightened fashion. Plaintiff was taken to the 42nd Precinct, where he was fingerprinted, searched, unlawfully interrogated without presence of counsel, and illegally detained in a dank and dirty cell for nineteen hours before being taken to Central Booking where Plaintiff was fingerprinted, searched and illegally detained throughout various cells for ten hours. Defendants caused a criminal court complaint to be filed against Plaintiff in Bronx County Criminal Court. Defendants fabricated false evidence which they forwarded to the Bronx County DA for prosecution. On March 15, 2021, plaintiff was released from physical custody after his criminal court arraignment. While at the precinct, Plaintiff was interviewed by Internal Affairs regarding the inappropriate touching. She was then transferred to Central Booking and charged with obstructing governmental administration, among other related charges. Plaintiff was held in custody for approximately 30 hours before being arraigned in Bronx County Criminal Court and released. After her release, Plaintiff sought medical treatment at Montefiore Hospital to address her injuries and check on her pregnancy, where she learned she had suffered a miscarriage due to the anxiety caused by the incident.
