There were four other individuals at the apartment - Melissa Vega, Edward Bristol, Jeanne Green, and Maurice Milliam (Mr. Milliam lived at the apartment). At approximately 10:00 p.m., Defendants Assencao and Police Officers John Doe and Richard Roe and other members of the NYPD executed a search warrant and forcibly entered the apartment. The Defendant Officers were dressed in plain clothes and were wearing helmets and bullet proof vests. They entered with their guns drawn and were yelling at the people inside. Plaintiffs were handcuffed and while detained they pleaded to the officers to let them go as they had no knowledge of any criminal activity. Defendants and other officers allegedly recovered a quantity of marijuana and cocaine from the apartment. Plaintiffs were arrested and transported to a nearby precinct where they were charged with Criminal Possession of a Controlled Substance in the First Degree, Criminal Possession of a Controlled Substance in the Third Degree, and Unlawful Possession of Marijuana. All of the individuals at the apartment were arrested and detained. Plaintiffs were held at the precinct for several hours and then transported to Queens Criminal Court where they spent the night of August 4, 2011 in jail. They were arraigned on August 6, 2011 and plead not guilty. Bail was set and the Plaintiffs could not post bail. On August 10, 2011, the Queens County District Attorney's Office dismissed all felony narcotics charges against the Plaintiff upon learning that the recovered substances were not controlled substances. Plaintiff Lawrence Perry was released after the Court granted the motion for a marijuana ACD. Plaintiff Allen Perry was released after he plead guilty to a violation, disorderly conduct.
