Plaintiff was a paid confidential source for the City of New York through the Office of the Special Narcotics Prosecutor and the DA, starting in 2001. Through his role as a confidential source, Plaintiff assisted in numerous drug related operations. Plaintiff's primary point of contact was Defendant Sabater. Defendant Sabater encouraged Plaintiff to participate in illegal activities and grow marijuana in his backyard to make his cover identity as a drug dealer more believable. Plaintiff was always told that the Defendants would provide protection and prevent prosecution due to Plaintiff's role as a paid confidential source. \n\nOn June 26, 2007, the Defendants arrested Plaintiff and his common-law wife for allegedly selling drugs on June 15. After coercion and without being Mirandized, the common-law wife admitted to selling drugs and that there was heroin in her home. Plaintiff denied all involvement with his common-law wife's activities. Pursuant to a search warrant, heroin was found in the common-law wife's belongings. Plaintiff and his common-law wife were subsequently indicted by a grand jury with numerous drug offenses. False information was provided to the grand jury relating to the evidence and Plaintiff's identity as a confidential source was never discussed.
