Plaintiff began recording the officers' actions on his phone. In response, the officers slapped the phone out of his hands and used excessive force by grabbing him, throwing him to the ground, kicking and punching him, and ripping out his hair, causing serious physical injuries. Plaintiff was transported to Lincoln Hospital for treatment.\n\nAfter being discharged from the hospital on the same day, Plaintiff was taken to the 40th Precinct and later to Central Booking. The Defendant officers falsely reported to the DA's office that Plaintiff had assaulted them to cover up their use of excessive force. Based on these false claims, Plaintiff was charged with assault and other crimes he did not commit. After approximately 30 hours in custody, Plaintiff was arraigned and released. Defendant Checo, along with defendant NYPD officers Moises Garcia (Shield No. 5782) and Thomas Warkenthien (Shield No. 3876) then chased plaintiff down the street. Defendant Checo then exited his vehicle and drew his gun on plaintiff, noting that he would shoot plaintiff to stop him. Defendants Checo, Garcia and Wakenthien then tackled plaintiff to the ground, punched him, kicked him, beat him and handcuffed him. One of these three defendants put his knee on the top side of plaintiff's face, pressing it into the ground. Plaintiff was taken to a local precinct and processed, and was denied medical care by defendant NYPD sergeant Stephen Monroe (Shield No, 2330). Plaintiff was eventually taken to a hospital. Plaintiff suffered severe injuries as a result of this incident. Defendants proceeded to maliciously prosecute plaintiff despite knowledge that he had committed no crime.
