Mr. Hernandez and his wife were out for dinner to celebrate her recent eye surgery, from which her recovery was almost complete. As they were leaving the restaurant, the defendant NYPD officers approached them and accused Mr. Hernandez of hitting his wife. The two tried to explain that she’d recently had eye surgery and was still healing. It was at this point that the defendant NYPD officers, Kachun Cheung (shield #5890) and John Doe #s 1-10 (identities unknown), began to unlawfully arrest Mr. Hernandez, restraining him with metal handcuffs and leg shackles. At no time did Mr. Hernandez commit a crime or violate the law in any way, nor did the police officers have an objective reason to accuse him of committing a crime or violating the law in any way.\n\nNevertheless, Mr. Hernandez was unlawfully arrested, handcuffed, and shackled\nby defendant officers without legal justification or probable cause, then placed in the back of an unmarked police vehicle and transported against his will to the 6th Precinct Police Station, where he was unlawfully searched, fingerprinted, photographed, and placed in a holding cell. While Mr. Hernandez was in unlawful custody, the defendant police officers provided the New York County District Attorney’s Office with the false, misleading, and/or incomplete information that he had committed a crime. Specifically, the defendant police officers falsely stated to the New York County District Attorney’s Office that Mr. Hernandez committed the crime of Third Degree Assault without probable cause. On February 5, 2021, after approximately 24 hours in custody, Mr. Hernandez was arraigned in New York County Criminal Court and he was released on his own recognizance. At the arraignment on February 5, 2021, Assistant District Attorney Kaleigh\nShea requested a full order of protection, barring the Plaintiff from living in his own home, which was issued. As a result of his arrest, Mr. Hernandez missed approximately four (4) days of work, as well as incurred fees for a private defense attorney and an extended hotel stay. The NYU surgery records were sent to ADA Shea within 2 days of the arraignment, which clearly showed an eye procedure done to Plaintiffs wife. Plaintiff instructed his cousin to start recording the actions on a cell phone, remaining a safe distance from the officers. At that time, Defendant Maloney and one other named Defendant pointed at Plaintiff and directed defendants Cheung, Shouldis, Ambrecht, and one other Defendant to walk toward Plaintiff. Defendant officers instructed Plaintiff and his cousin to move back, with which they complied, with Plaintiff raising his hands over his head as he stepped back. Defendant officers failed to inquire whether Plaintiff or the cousin were essential workers, and Defendants Cheung, Shouldis, Ambrecht, and one other grabbed and tackled Plaintiff to the ground, later joined by Maloney, Dones, Collarini, Cary, and Matos. Multiple Defendants, including Dones, Carey, Shouldis, Maloney, Cheung, Ambrecht, Collarini, and Matos, beat Plaintiff about the torso and legs, twisted his arms behind him, and struck his head with a police baton or other blunt instrument. A defendant officer then knocked the cellphone used to record out of Ms. Kiyee's hands and then subjected her to excessive force and false arrest. Officers believed to be Collarini and Shouldis, after handcuffing Plaintiff and placing him face down on the ground, punched Plaintiff multiple times in the back.
