Later, an argument broke between 4 people at the party, resulting in one person getting stabbed and the other getting shot (death). Det. Hutchison and Vasquez conducted interviews after the violent incident, and during the process, called the Plaintiff's ex-girlfriend who happened to be the sister of the person that got stabbed at the party. Angry that the Plaintiff had another girlfriend, the ex-girlfriend lied and claimed the Plaintiff was the shooter. Despite knowing that the ex-girlfriend could not know who the shooter was (as she was not at the party), and not being able to identify a potential suspect, the individual Defendants began to pursue the Plaintiff as the primary suspect. Det. Eggers conducted a tenant search for the Plaintiff, and Det. Hutchison and Vasquez fabricated photos of the Plaintiff from two years prior to make him look similar to the appearance witnesses testified to seeing. Additionally, the victim that was stabbed at the party testified that the shooter was someone else. However, the Defendants ignored this information and intentionally disregarded the testimony. The Defendants continued to build a case against the Plaintiff and withheld relevant information that would undermine the Plaintiff as the suspect. Det. Hutchison and Vasquez arrested the Plaintiff on March 26, 2004, without a judicial arrest warrant as required by the Fourth Amendment. Det. Hutchison interrogated the Plaintiff four hours, in attempt to get him to change his story.
