While sitting, officers approached Gallego and searched the bag he was holding because it had a stitched marijuana leaf on it. Officers did not find any marijuana or other unlawful items inside the bag. Officers ordered him off of the train. One officer dragged Gallego out by grabbing his forearm and threw him on the floor of the subway platform. Another transit officer grabbed Gallego and threw him against a wall, slamming his face into it. Gallego was arrested for occupying more than one seat on the subway, and incarcerated for 17 hours.
