Plaintiff attempted to alert police officers that prohibiting access to the steps was unconstitutional, and as the officers continued to block access, plaintiff began chanting \"Treason!\" Without warning, officers grabbed plaintiff, forcing him away from the other demonstrators. Officers including PO Anthony Ciaramitaro arrested plaintiff and made false sworn statements charging him with disorderly conduct and resisting arrest. Officers placed plastic flex-cuffs tightly around plaintiff's wrist, causing significant pain. They transported him to One Police Plaza and detained him for 24 hours. On July 24, 2013, the charges against plaintiff were dismissed and sealed. On November 12, 2011, plaintiff was again participating in an Occupy Wall Street demonstration, when PO John Doe grabbed him and arrested him without probable cause. He was held at One Police Plaza for 10 hours before being released with a summons. PO John Baiera handcuffed the plaintiff tightly with plastic cuffs. Plaintiff complained that the cuffs were too tight and painful, but the officers ignored her. Plaintiff was further injured as the cuffs were eventually cut off her wrists, because of how tight they were.
