Plaintiff exited the vehicle to return home, Defendant NYPD officers Collins, Haynes, Giudice, Stelmach and Zebro exited an unmarked police car and approached Plaintiff and the vehicle's driver. Plaintiff and the driver did not do any crimes, but Defendant Zebro ordered Plaintiff without cause to stop about one half block from the location where the vehicle was parked, which Plaintiff did. Defendants told Plaintiff to go back to the car, and Plaintiff complied. Plaintiff used his cellphone to record his encounter with the officers. Plaintiff asked why he was being stopped and the officers refused to tell him. Defendant Zebro told Plaintiff that he couldn't leave and asked for photo identification. Defendants detained Plaintiff without cause. Defendants Stelmach and Zebro threw the driver on the ground and assaulted the driver while Plaintiff begged defendants to stop. Defendant Haynes shoved Plaintiff and grabbed Plaintiff's shoulders and arms and pushed Plaintiff into a fence gate, striking Plaintiff's right side of his body and pinning him against the hard surface. Defendant Haynes caused Plaintiff pain to the right side of his chest and ribs, back, right shoulder, right arm, bruising, swelling and a reduced range of motion. Defendants Haynes, Collins and Giudice surrounded Plaintiff and continued to unlawfully detain him by forcibly grabbing his person and unlawfully searching his clothing. Defendant Hayne shined his flashlight into Plaintiff's cellphone to interfere with Plaintiff's recording. Defendant Haynes shoved Plaintiff to prevent him from recording. Defendants also obstructed Plaintiff's cell phone camera. Defendants retaliated against Plaintiff for recording by detaining, searching and assaulting Plaintiff. Defendants Collins, Haynes and Zebro unlawfully searched Plaintiff by putting their hands inside of Plaintiff's clothing and grabbing his person. No criminal charges were filed against Plaintiff. Plaintiff attempted to provide a key to the new lock to the individual, when the individual threatened to shoot him. Plaintiff retreated from the building and called 911. The individual who threatened Plaintiff also called 911 and falsely reported that Plaintiff had brandished a firearm at the individual. Several plain clothed NYPD officers arrived at the scene who verified that the Plaintiff was not armed. One of the Defendant officers, Phillips, continued to focus on whether Plaintiff was armed and did not investigate the threats made to Plaintiff by the individual. After further investigation, Defendant Phillips placed Plaintiff under arrest for criminal possession of a firearm, menacing, and harassment. The other officers present at the scene did nothing to stop this injustice. \n\nPlaintiff was arrested and taken to the precinct and eventually Central Booking. A protective order was put in place preventing Plaintiff from entering his property and interacting with the individual that had threatened Plaintiff. As a result of his false arrest, Plaintiff's Global Entry access was revoked, which resulted in Plaintiff's detainment upon reentering the US at a later date. Mr. Ross did not have his ID on him, but he explained that his mother who was nearby had his ID. The officers ignored him and arrested him, cuffing his hands tightly behind his back and ignoring his pleas not to cuff him so tightly because of a prior arm fracture. Mr. Ross was denied medical assistance despite being in excruciating pain. All charges against Mr. Ross were false and his arrest was subsequently voided. Plaintiff was shot in his right arm, lower back, and through the backs of both of his legs. A bystander whom Plaintiff did not know helped Plaintiff and called an ambulance for him. Shortly thereafter, an ambulance and police vehicles arrived at the scene. Plaintiff was placed on a stretcher, loaded into an ambulance, and transported to Kings Hospital for treatment. A police officer accompanied Plaintiff in the ambulance and unlawfully arrested him without probable cause or legal justification. Plaintiff remained in police custody and was unlawfully handcuffed and shackled to a gurney until March 13, 2014, when he was discharged from the hospital. Immediately thereafter, Plaintiff was transported to the 67th Precinct, where he was detained in a holding cell for several hours. Plaintiff was in so much pain from his wounds that he was transported back to the hospital via an ambulance to receive further treatment. Plaintiff was prescribed pain medication and transported back to the 67th Precinct, where he remained in a holding cell overnight until March 14, 2014. Plaintiff was in severe pain during his detainment because he was not permitted to take the medication just prescribed to him at the hospital.\n\nIn the morning, Plaintiff was transported to Kings County Central Booking. NYPD Officer Garret Gorham, Officer Sean Collins, Officer Gregory Johnson, Sergeant Mark Smith, and several unidentified NYPD officers provided false information to the District Attorney’s office, which initiated the prosecution against Plaintiff. After approximately 12 hours in Central Booking, Plaintiff was arraigned on March 14, 2014, and charged with several crimes based on these false allegations. Plaintiff was unable to post bail immediately, so he remained in police custody until March 16, 2014.
