While executing the Order, the ACS Defendants unnecessarily and without legal basis requested the Swat Team to the premises. This Swat Team, once arriving, failed to assist ACS Defendants in determining the safety status of the Children and focused solely on compelling the entry from Plaintiff and Plaintiff’s girlfriend. Plaintiff was unable to require the owner of the apartment to open the door and asked the Swat Team if he was allowed to leave. The Swat Team Informed Plaintiff that they would not allowed him to leave. Effectively imprisoning him inside the apartment. In order to avoid calamity, Plaintiff was forced to exit through the apartment window. There was no fire escape, and Plaintiff broke his leg upon falling onto the ground. After falling onto the ground, Plaintiff waited in the outdoor area around the building. Plaintiff was arrested outside, he was charged with endangering the welfare of a child and obstruction of governmental administration. Plaintiff was unlawfully arrested and charged with §§§§ 195.05, and 261.10(1) – 3 counts. Plaintiff spent about five days in custody before being released on his own  recognizance. Jesse Lance knocked on the door under the false guise that they had heard gunshots.  The officers insisted that they enter the premises, but plaintiffs demanded a warrant to allow entry.  This encounter lasted for more than hour, and the officers didn't allow plaintiffs to close their front door.  As some of the plaintiffs were peacefully exiting, one plaintiff was dragged outside of the subject premises, pushed against the side of the building, and had his phone snatched from his hand by the officers when he attempted to record the assault.  The officers stopped, frisked, searched, and fondled him and kept using the \"N\" word.  The officers similarly frisked and searched another plaintiff that tried to leave and kept using the \"N\" word.   \n\nThe officers forced their way into the premises and directed everyone to sit down and threatened that they were in trouble because they were giving the police a \"hard time.\"  The officers also threatened to call ACS on some of the plaintiffs inside the premises because there were minor children present.
