In the vicinity of 77-01 Roosevelt Avenue, Queens, NY, Plaintiff was pulled over by two NYPD officers in an unmarked car who asked for Plaintiff's license and registration, which were both valid and which Plaintiff provided. Plaintiff was then told to exit the vehicle at which time he was seized, searched, and placed in tight handcuffs that caused Plaintiff lasting pain and injury. No contraband was found and Plaintiff had not committed a crime otherwise. While en route to the 115th Precinct, Plaintiff was told to stay quiet when he complained about the tight handcuffs. After 6 hours at the 115th Precinct, where he was denied water and a phone call, Plaintiff was taken to Queens County Central Booking where he was charged with Unauthorized Use of a Vehicle. Plaintiff was arraigned and released on his own recognizance that same day (June 11) but the exact time of his release is not stated. Plaintiff took an ACD at his next court appearance and all charges were dismissed.
