As the Plaintiff was exiting the 7-train subway car and walking onto the platform he noticed three undercover male Defendant Officers approaching him.  The officers instructed Plaintiff, and two other individuals to “Step over here to the side”.  The Officers were not in uniform, and did not announce themselves as police officers or present a badge when they demanded Plaintiff’s identification. The Plaintiff presented immediately and did not have any open warrants. The Officers then grabbed Plaintiff’s arms, pinned them behind his back, put metal handcuffs on his wrists and conducted a pat-down search of Plaintiff.  Although the Officers did not recover drugs, weapons or other contraband they took Plaintiffs wallet and cellphone before transporting him to the Transit District One Headquarters in handcuffs, where he was searched, photographed, fingerprinted, and interrogated.  Officers confiscated Plaintiff’s belongings including keys off his key ring, two Metro Cards, and two photos of his daughters for which he did not receive a voucher and he observed as the officers searched his phone, documenting phone numbers from his contact list. After being placed in a holding cell, the defendant informed the officers that he was dizzy and requested food and water, and he was given one cup of water and no food. When he reiterated his request the officers refused again. Also, Plaintiff requested a telephone call in order to explain to his boss that he would be late for work while in the holding cell.  Plaintiff was not permitted to make the call and he lost his job as a result. During  the Plaintiff's detentions submitted false and/or inaccurate information to the Manhattan District Attorney’s Office which accused him of committing a crime, and after several hours he was transferred to Central Booking. During his transfer he told the officers the handcuffs were too tight and requested that they loosen them as they aggravated a pinched nerve under his left arm.  At Central Booking Plaintiff was searched, fingerprinted and had his retinas scanned. Plaintiff then requested medical attention approximately three times and instead of receiving medical attention, he was asked medical questions about his mental health. The Officers informed the Plaintiff that if he  said ‘No’ to the questions and he would get out faster.  Plaintiff again requested both food and a telephone call while being detained and he was denied.  After being held for several hours, Plaintiff was brought before a judge who dismissed all criminal charges at his arraignment on September 17, 2022. After approximately 20 hours in custody Plaintiff was released and went to went to Westchester Hospital, where he received a cortisone injection for his pinched nerve that was aggravated by the tight handcuffs.
