The plaintiff was playing basketball with friends when officers of the NYPD, including Sergeant David Grieco (shield #3830) ordered Mr. Lubin and his friends to leave the basketball courts in Nostrand Park. Mr. Lubin then went with his friends to the Flatbush Gardens Apartment complex. When Sergeant Grieco observed Mr. Lubin and his friends conversing in the courtyard of the building, he and his team proceeded to harrass, stop, search and, without a court-ordered warrant or probable cause, arrest Mr. Lubin. Mr. Lubin was transported against his will to the 67th Precinct, where he was searched, processed and detained further. The assault and battery consisted of being grabbed, punched, groped, fondled, had her clothes torn, was thrown to the floor, tased, stomped and thereafter was forcefully placed in handcuffs. While in handcuffs, one of Defendants Police Officers placed a finger in Plaintiff's mouth and asked her to \"suck it\". One of Defendant Offices used a Taser and/or other conductive energy device on Plaintiff excessively without justification causing her to sustain injuries. Defendant Police Officers created and submitted an erroneous police report in an effort to cover up the aforesaid and initiate a prosecution in bad faith.
