Plaintiff declined to accept the plastic tube, which fell to the ground, spilling marijuana onto the sidewalk. Plaintiff was physically seized by Defendants Pichardo and Nikqi without probable cause or reasonable suspicion.\nPlaintiff was placed under arrest, handcuffed, led to the unmarked car and brought\nto the 46th Precinct in the Bronx. At the 46th Precinct, Defendant Nikqi created police reports falsely claiming that Breton possessed a loaded firearm, marijuana and a plastic tube. As a result of the false police reports and property clerk invoices, Breton was charged by the BCDA with Criminal Possession of a Weapon in the Second Degree and related firearms offenses, and Unlawful Possession of Marijuana. On July 1, 2022, the prosecution terminated favorably for Breton when a jury returned a verdict of not guilty. During the more than four years that Plaintiff was forced to defend false criminal charges, Breton suffered, and he continued to suffer, emotional distress.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=2flKqNOzeMqZp1_PLUS_80hxcjA==","type":"complaint"}]},{"name":"Gell, Elvis, et Al vs Detective Francis Conejo, et al.","start_date":"2022-03-17","disposition_date":"2023-10-06","payout_amount":24999.99,"disposition":"Settlement","docket":"21CV10225","court":"U.S. District Court - Southern District NY","summary":"On February 6, 2020 NYPD officers entered the home of the 3 plaintiffs in this matter. Two unidentified officers, for no apparent reason, forcefully brought the first plaintiff to the ground and placed him in overly tightened handcuffs, and he kneed him in the back. The officers continued to inflict pain after plaintiff informed them of medical condition and plaintiff's wife, the second plaintiff, implored them to stop. He now requires pain management sessions for his back and knee. His wife, the second plaintiff, was asleep in bed when the unidentified male officers entered her bedroom with guns drawn. The officers handcuffed her tightly to her bed; she informed them that the handcuffs were too tight and the officers dismissed her concerns. She asked for the evidence that justified their presence in her home and they informed her they would find it. After finally granting her repeated requests to use the restroom, a male officer stood and watched her while she was entirely exposed to him. They took her to the 30th precinct; she complained she wasn't feeling well; her blood pressure was so high that she had to be rushed to the hospital. The officers informed her while she was in the hospital that the charges were dropped and refused to help her find her way home despite taking her money, phone, and metro card. The third plaintiff is the son of the first two plaintiffs. He was asleep in bed when five unidentified officers entered his bedroom with their guns drawn. He lifted his hands to indicate he was unarmed, but the officers threw him to the floor and kneed him in the back and damaged property in his room before taking him to the precinct.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.571041/gov.uscourts.nysd.571041.20.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/61587697/gell-v-conejo/"},{"name":"Roderick, Hasan vs City of New York, et al.","start_date":"2018-11-19","disposition_date":"2022-04-28","payout_amount":20000,"disposition":"Settlement","docket":"033012/2018E","court":"Supreme Court - Bronx","officer_name":"Conejo, Francis J.","summary":"On or about July 10, 2016, at approximately 5:00 P.M., in the vicinity of 181st Street and Valentine Avenue, which the police state occurred at approximately 9:19 P.M., in the vicinity of the front of 317 East 181st Street, County of Bronx, State of New York, Defendant NYPD officers illegally pulled over the vehicle Plaintiff was in, allegedly to test whether the windows were excessively tinted. However, instead of conducting the “tint test,” they used the alleged violation as a pretext to unlawfully search the entire vehicle, including the trunk. While effectuating the seizure of Plaintiff, Defendants searched, seized, assaulted, battered, and grabbed Plaintiff in an excessive manner. The handcuffs were placed on Plaintiff’s wrists so tight that Plaintiff’s wrists turned red. Defendants’ conduct caused Plaintiff both physical pain and mental suffering. \nLater, Defendant P.O. They also had Plaintiff maliciously prosecuted there by providing false and/or incomplete information to the DA’s office. Plaintiff was thereafter held in custody for over 45 hours until his release.
