Detective Kieron Ramdeen and fifteen unidentified police officers broke into the apartment on a warrant issued on the basis of unreliable information, searching for an individual other than Plaintiffs. Plaintiffs pointed firearms at Plaintiffs. The NYPD officers: shoved Plaintiff Amparo Alvarez and forced him down; slammed Plaintiff Francisco Alverez down, dragged him across the floor, struck him, hit him in the testicles, and placed excessively tight handcuffs on his wrists; grabbed Plaintiff Gil Alvarez’s beard and punched him in the face; and were abusive and rude to Plaintiffs.\n\nAlthough they found no basis to arrest Plaintiffs, the NYPD officers transported Plaintiffs Francisco Alvarez and Gil Alvarez to the 46th Precinct for arrest processing and eventually to Manhattan Central Booking for arraignment. Plaintiff Amparo Alvarez was not taken from her home and eventually released from custody without charges. The police took Plaintiff’s personal property but failed to voucher any of it. The NYPD officers falsely and maliciously told the District Attorney’s Office that Plaintiffs Francisco Alvarez and Gil Alvarez had committed various crimes, and the District Attorney prosecuted Plaintiffs for various charges. At arraignment, Plaintiffs were released on their own recognizance.
