Defendant Gamble and others attacked Plaintiff from behind, struck his head with a baton, tackled him to the ground injuring his wrist and forehead and cracking his phone screen. Defendants forcefully pressed a knee or elbow into Plaintiff's left shoulder and pressed his face into the ground. Defendants tightly handcuffed him with zip ties that were so tight Plaintiff lost the feeling in his hands. Plaintiff was detained for six hours. Defendants ignored his repeated requests for medical attention or request for a face mask to protect against Covid-19, as his had been knocked off during Defendants assault and arrest of him. Plaintiff was released with summons for violating the New York City curfew despite police giving no order to disperse at the protest. Plaintiff was taken to the 81st Precinct where he was processed and charged with 3 felonies and a class A misdemeanor. Plaintiff was detained at Rikers Island for 9 days and on March 23, 2012, was released on a $25,000 bond. On October 10, 2012, all charges were dismissed on the application of the Kings County DA's Office.
