Approximately two hours later, half a mile away, a teenager was shot and killed. The shooting occurred while Mr. Amilcar was confirmed to be in his home. Footage of the shooting also demonstrated two suspects running away physically unhindered while Mr. Amilcar was shown on camera visibly injured as he entered his building earlier that day. Police then retrieved video surveillance from Amilcar's neighboring building before his March 4, 2019 arrest. \n\nOn the day of Mr. Amilcar's arrest, Defendant Captain Noema Ioffe made a public statement claiming that \"Mr. Amilcar discharged a firearm at a 15-year-old victim, causing his death,\" even though Mr. Amilcar was only a suspect. The unequivocal assertation that Mr. Amilcar committed the shooting was further continued by news outlets throughout the ensuing days. Upon Mr. Amilcar's arrest, where Defendant Detective Nuñez was present, he still had a visible limp, and Defendant John Doe 1 grabbed Mr. Amilcar and violently threw him to the ground. Mr. Amilcar stated that he was not resisting, was injured, could not run, and wished to be taken directly to the precinct. Defendant John/Jane Does 1-10 picked Plaintiff off the ground and pushed him into a metal gate so forcefully that it knocked bricks off of the wall and taunted him in doing so. Plaintiff was then transported and interrogated. During Defendants Detectives Pignatelli and Welch's interrogation of Mr. Amilcar, Plaintiff was not fed before or during the several-hour ordeal.\n\nAt Plaintiff's subsequent arraignment, bail was denied. Plaintiff was incarcerated at Rikers for nine months until bail was finally set, which he then posted. Upon his release from Rikers, Plaintiff was forced to wear an ankle bracelet under house arrest and prohibited from removing the bracelet even under medical pretenses, which prevented him from receiving an MRI. In this statement, Defendant Captain did not allege Plaintiff caused the 15-year-old's death or accuse Plaintiff of causing his death -- Defendant Captain Ioffe directly said Plaintiff caused his death. The next day, multiple new outlets, including the New York Times, ran stories about the killing and named Plaintiff in their stories as a result of Defendant Captain Ioffe's statement. \n\nIn the evening of March 4, 2019, Defendant Officer Nunez falsely arrested Plaintiff in Queens, while he was out walking with a noticeable limp. Defendant Officer John Doe 1 grabbed Plaintiff and violently threw him to the ground. Plaintiff told Defendant Officer John Doe 1 he was not resisting arrest, couldn't walk, and to just take him to the precinct. Defendant Officers John and Jane Does 1-20 picked Plaintiff off the ground and threw him into a metal gate, which knocked bricks off the wall. Defendant Officers laughed at Plaintiff and told him he would have to pay for the damaged bricks. \n\nUpon arrival at the precinct, Plaintiff was questioned for several hours by Defendant Detectives Erin Pignatelli and Davida Welch about his involvement in the shooting. Plaintiff showed Defendants his stab wound and that he could not possibly have run away. Defendants also possessed surveillance footage of Plaintiff at the time of his arrest but failed to review the footage. Defendants did not tell the grand jury that Plaintiff had been stabbed and was walking with a limp. Plaintiff's lawyer also provided Defendants with photograph and video evidence establishing Plaintiff's alibi. Nonetheless, Defendants continued prosecuting Plaintiff and kept him jailed for nine months on Rikers Island where he was attacked by other inmates and sprayed by chemical agents. \n\nUpon release from Rikers Island, Plaintiff was placed on how arrest for two more years despite Plaintiff continuously pleading his innocence. Plaintiff was forced to wear the ankle bracelet, causing a delay in proper medical treatment.
