Despite protests from Mr. Burke, his account manager, and HRA officers that Mr. Burke had done nothing wrong, officers Michael Pena, Richard Melees, Sergeant Shannon Brooks, and Undercover Officer 303 arrested Mr. Burke, alleging he was involved in criminal activity. He was handcuffed tightly, causing pain, and detained for several hours before being transported to the precinct and then Central Booking. Mr. Burke was falsely charged with crimes related to drug activity, and the charges were dismissed on July 27, 2016. On or about November 8, 2012 Plaintiff was convicted and sentenced to prison.
