After realizing that the dispute between Newland and her husband had been resolved, the officers discussed the matter among themselves and then proceeded to arrest her without cause or a warrant. Newland and her husband informed the officers that she was recovering from two surgeries on her right arm and that her arm could not be placed behind her back without causing further injury. Despite this, the officers forcibly twisted her right arm behind her back, causing a cracking sound and severe pain. She was then dragged from her home barefoot and in a nightshirt, forcibly placed into a police vehicle, and transported to the 113th Precinct.\n\nAt the precinct, Newland was placed in a holding cell for four to five hours and denied medical attention, despite her visible pain and multiple requests for treatment. She was later transferred to Central Booking, where she was again denied medical care and held for several more hours before being arraigned on charges of criminal possession of a weapon, menacing, and harassment. Instead of letting the boys go, the officers took them to the 103rd precinct.  That night the complainant identified the plaintiff as the person who assaulted him.  Plaintiff was arraigned on Oct. 27th 2012 and bail was set at $100,00 dollars cash or $75,000 dollars bond and then remanded to the Boat (VCBC) were he remained until Nov. 6-7th, 2012 when the Captain informed him that the charges were dismissed and he would be released immediately.  The charges were dismissed because the Complainant fully recanted his statement.
