Defendant falsely accused plaintiff of having assaulted an individual. Prior to the underlying incident, this individual was known to the police department for making false complaints in the past. Based on information obtained, the Defendant police officers should have known that the individual lacked credibility and veracity and should have investigated the incident in more detail before arresting the plaintiff. There was no probable cause to arrest plaintiff however the officer’s arrested plaintiff and charged him with assault and was placed in custody without his consent. While arresting the Plaintiff, the Defendants placed excessively tight handcuffs. Plaintiff requested the Defendants to loosen the handcuffs, however the officers refused. The tight handcuffs caused physical injuries to the plaintiff. On January 20, 2023, the defendants initiated a criminal prosecution of plaintiff without probable cause charging him with crimes he did not commit. The action of defendants were intentional and malicious.
