This false allegation was a pre-textual basis for stopping Plaintiff's vehicle. After Plaintiff pulled his vehicle to the side of the road the police officers approached his vehicle, ordered Plaintiff to step out of the vehicle, and asked plaintiff for his license and registration. Defendants searched Plaintiff’s person and vehicle without probable cause or legal justification and did not recover any illegal drugs, weapons, or contraband pursuant to the search. Although the defendants lacked probable cause to believe Plaintiff committed a crime, the officers unlawfully handcuffed Plaintiff and falsely arrested him without probable cause or legal justification. On May 21, 2017 at 11:00 pm Plaintiff was arraigned in Bronx Criminal Court and was maliciously charged with Operating a Motor Vehicle Under the Influence of Alcohol, without probable cause and based upon the false, misleading and incomplete information and evidence provided by defendants to the District Attorney’s Office. While at the precinct, EMS was called to treat plaintiff for the physical injuries inflicted by the defendant police officers and plaintiff was further treated at Lincoln Hospital for numerous injuries on August 13, 2015 around 3:30 am. On August 13, 2015 at approximately 1:30 pm, plaintiff was discharged from the hospital and transported to central booking. \n\nDefendant police officers falsely stated to the Bronx County District Attorney’s Office that plaintiff had committed a crime despite knowing that they lacked a legal and a factual basis to allege that plaintiff committed any crime. On August 14, 2015, at approximately 1 pm, after around 36 hours in police custody, plaintiff was arraigned and the Judge set bail. The same day at 1 pm, plaintiff was able to post bail and was released from the courthouse. Plaintiff was charged with assault, disorderly conduct, obstructing governmental administration and harassment. After he was released, plaintiff received more medical treatment at Mt. Sinai Medical Center and complained to the medical staff at the hospital that his right elbow and face, among other things, were injured by defendant police officers.
