Plaintiff called 911 to ask for help, and around the same time her roommate also called 911. Plaintiff waited for the officers alone in the lobby of her building, where she was eventually approached by NYPD officers including Officer Morant. Plaintiff lucidly and calmly explained the situation in her apartment, but defendant Officer Morant menacingly drew her pepper spray and asked accusatorially what Plaintiff had done to cause such a conflict. Plaintiff's eye disease that causes her eyes to bulge may have made defendant officers question her credibility in this instance, based off of her difference in appearance. Defendant officers told Plaintiff to enter her own apartment ahead of them, despite her expressing her own fears. The officers saw the situation, heard about the roommate's death threats and crack habit, and spoke to the roommate, and made jokes about the excrement on the floor. The roommate falsely claimed that Plaintiff had swung at her with a baseball bat. Despite lack of evidence to substantiate this claim and lack of credibility from the roommate, Plaintiff was arrested and handcuffed tightly, causing a permanent scar on her wrist. Plaintiff was searched and incarcerated in the local precinct, and was not allowed to bring a coat despite inclement weather and being underdressed in gym clothes. The roommate was neither arrested nor charged for her behavior.
