At the ambulance, defendant officers opened the door, forcibly dragged Plaintiff up the stairs and threw Plaintiff inside the ambulance.  Plaintiff sustained serious injuries on various parts of his body as a result of the assault by defendant officers, and was transported to Brookdale Medical Center. After detaining Plaintiff for a lengthy period of time at the hospital and precinct, Plaintiff was transported to Central Booking for arraignment. Defendant officers met with prosecutors employed by the Kings County DA’s Office, and falsely stated to the prosecutors, that Plaintiff committed the charged offenses. Based on defendant's false testimony, a prosecution was commenced against plaintiff. On April 23, 2013, Plaintiff's case was adjourned in contemplation of dismissal. The officers started searching the counters for movies, and then searched the plastic bins located behind the counters and confiscated about 40 movies from Mr. Harvey. They arrested Mr. Harvey and placed him in handcuffs, too tightly. Mr. Harvey asked the officers to loosen the tight handcuffs but they refused. Mr. Harvey was left with marks and bruises that lasted for several days. The officers refused to tell Mr. Harvey why he was being arrested, and took him to the 73rd Precinct where he was searched, fingerprinted, photographed and detained in a cell. \n\nAt the precinct, the officers did not ask about the movies, instead they questioned Mr. Harvey about guns, drugs and whether he knew certain individuals . He was later released and told to appear in court 45 days later. When he appeared in court 45 days later, he was told that his case was not ready, and was told that if he did not hear from the court again his case was dismissed. The Office of the District Attorney subsequently declined prosecution.\n\nOn March 17, 2013, Mr. Harvey was arrested by Police officer Peter Lazare with one other police officer while he was with friends. He was taken to the 73rd Precinct where he was searched, fingerprinted, photographed and detained in a cell. He was later taken to Central Booking. he was charged with fraudulent accosting.
