Two women and a mand were walking behind them and they stated to complain about their walking speed. One of the women suddenly hit the plaintiffs hand trying to seperate them and then Plaintiff Vargas and the women argued which led to physical altercation. The male took out a machete and theretened to strike Plaintiff Davis when Defendant officers Pena and Carter arrived at the scene. The officers pushed  and searched Vargas, but she wasnt taken into custody. Davis was tackled by the defendants handcuffed, dragged and pushed. He hit his head and started bleeding and was unable to breath, which he complained to the defendants about. Davis was transported by the ambulance while in custody and was handcuffed and shackled to the hospital bed for four days prior to being arraigned at Central Booking. Davis was charged with robbery, assault and petit larceny. He was released from custody but had to return to Court several times until the charges against him were dismissed on July 24, 2019.
