Plaintiff Espada was ambushed and illegally detained by private citizens from Breen Bros. Towing, which had an arrangement with municipal agencies to store their vehicles and did so illegally on Plaintiff AKP's property. When NYPD Officers Daniel Center and Robert Campbell arrived at the scene, they ignored the illegal actions of Breen Bros. and instead targeted Plaintiff Espada at the request of Joseph Breen. Despite Plaintiff Espada informing Officers Center and Campbell that he was an employee of AKP's listed towing company, which Officer Center confirmed, they arrested Plaintiff and allowed Breen Bros. to drive Plaintiff Espada's tow truck to return the vehicles to AKP's property. The NYPD subsequently retained the tow truck following Plaintiff Espada's arrest. When Plaintiff Plaza Body Shop, the towing company that Espada worked for, regained access to the truck, they discovered an SD card which had been recording the incident was missing. Plaintiff Espada was not read his Miranda rights at the time of arrest, and was not told of them until after being detained in the precinct for five hours. Eventually, more than 24 hours after this illegal treatment began, charges against Plaintiff Espada were dropped and he was released. A protective order was entered against Jacobs and he was released, however the protective order prevented him from returning home. Jacobs was arrested later that day by POs Lupo, Maciej Hajbert, Daniel Center and John and Jane Doe 1-10 near his home while he was awaiting his medication from his roommate because NYPD believed he violated the protective order.
