McMahon, Officer John Doherty, members of the US DEA NY Taskforce, members of the Office of the Special Narcotic Prosecutor, and members of the NYPD entered Plaintiff's apartment and began to destructively serach the premises. Plaintiff's wife, two sons, and stepson were also handcuffed and the entire family was detained. The LEO stated they had a search warrant for the first and second floors of Plaintiff's residence, which had been procured by Agent Fogarty and signed by Honorable Laurie Peterson -- the search warrant relied upon an Fogarty's affidavit that included false claims. LEO did not find any contraband or evidence of illegal activity on the first and second floors of the residence. Despite not having a search warrant to search the third floor, Agent Fogarty, Agent Santos, Agent Tamweber, Agent Maher, Lt. McMahon, and Police Officer Doherty deliberately went beyond the scope of the search warrant to forcibly enter and search the third floor premises where they found drugs and other evidence of criminal activity. LEO including Agent Fogarty, Agent Santos, Agent Tamweber, Agent Maher, Lt.
