Plaintiff was the lawful owner and landlord of 24 Maxie Court since the year 2007. At the aforementioned time and place, Mr. Perkins was threatened, chased and charged by the tenant who had been living in the downstairs apartment. Plaintiff became a victim of violence when tenant and tenant’s boyfriend attacked him. Plaintiff immediately called 911 to seek help and protection, and Defendant NYPD Officers Michael Birch, Golden Derrick, and John Does 1-4 responded and arrived at the scene. Upon arrival, Defendants without suspicion or probable cause improperly stopped, unlawfully searched, and unlawfully handcuffed and forced plaintiff into a police car.\n\nPlaintiff’s please for medical assistance were denied or otherwise ignored - Plaintiff did not receive medical assistance for his bleeding hand with open knife wounds or for aggravated and exacerbated back pain. Defendant has to endure this pain sitting in a police car in an uncomfortable position for 40 minutes while Defendant Officers tended to tenant. Medical attention for plaintiff was finally called after several attempts to acquired his fingerprints failed due to his hands being bloodied, and plaintiff was transported to Richmond University medical center. Upon returning to the precinct, Defendant officers denied and ignored the specifics medical instructions given for plaintiff.
