Balsamo and John Doe 1-10 improperly stopped, confronted, assaulted, battered, questioned, searched, arrested, and detained Devon Hamilton near 30-56 Whitestone Expressway of Queens. Hamilton was improperly targeted by the NYPD due to his race, religion, ethnicity, national origin, or other improper characteristic. Specifically, Hamilton was targeted for being an African American male. Despite being on the premise properly, he was stopped and questioned by the officers even though the officers possessed no justifiable reason to do so. The officers then fabricated and suppressed evidence and charged Hamilton with a crime he did not commit. While being handcuffed, Hamilton experience pain due to the tightness of the handcuff and asked the officers to loosen it. The officers, however, ignored the request. \nHamilton was detained without his consent for 8 hours until he was released. Hamilton was also maliciously prosecuted and was continued to be prosecuted despite the officers having no probably evidence to do so. At no time did the officers intervene to stop the officers' malicious conducts. The charges against him were ultimately dismissed.
