Following the arrest, the plaintiff was subjected to an intimate and humiliating body search and was detained at the 1st Precinct for over 18 hours. The plaintiff was falsely charged by defendants, including Angel Mendez and Ruby Francis, with reckless driving, resisting arrest, and reckless endangerment—crimes the defendants knew the plaintiff did not commit. Defendants took Plaintiff to the 9th precinct where he was photographed, fingerprinted, and placed in a cell for hours before being transferred to the hospital. Once he was done being treated, Defendants once again took him to the 9th precinct. The officers at the 9th precinct told Plaintiff that he was forcibly seized because the officers mistakenly thought that Plaintiff was involved in some type of “gang war.” They were mistaken and there was no evidence or indication that said theory was accurate. Plaintiff was then transported to New York County Criminal Court where he was held for thirteen more hours before being brought before a judge. He was charged with Disorderly Conduct, Resisting Arrest and Obstructing Governmental Administration. He was released from Arraignment Court after being in custody for more than 36 hours.
