While waiting for his nephew, plaintiff became aware that police were coming down the street, so he moved to the driver's seat and placed the keys on the dashboard in order to prevent his nephew from getting a ticket. Defendant NYPD officers, including officer Ramunno, pulled up, asked the plaintiff a few basic questions, then informed him he was under arrest for driving under the influence of alcohol. Despite the fact that the plaintiff re-iterated that i) he was not driving and ii) that the keys were on the dashboard, defendants tightly handcuffed him without any legal basis. \n\nDefendants proceeded to drive the plaintiff around, handcuffed in their van, for an hour before arriving at the precinct - during which the plaintiff pleaded he was in need of his required heart medicated - these pleas were ignored and ultimately lead to the plaintiff having to be taken to the hospital for heart palpitations.
