Defendants had intentionally provided false information to the Bronx County District Attorney and offered false, fraudulent and misleading testimony to the grandy jury convened to investigate the charges against Plaintiff to ensure that he was indicted. Plaintiff was arraigned and formally charged with three (3) counts of Criminal Conspiracy in the First Degree, three (3) counts of Criminal Conspiracy in the Second Degree, one (1) count of Criminal Conspiracy in the Third Degree and one (1) count of Criminal Conspiracy in the Fourth Degree. Plaintiff was unable to meet his bail conditions and was remanded to custody at Riker's Island, where he remained for 11 months until he was released on bail in March 2015. During his incarceration on Riker's Island, Plaintiff was forcibly subject to multiple strip searches with cavity inspections. Eventually, an officer removed the Plaintiffs' handcuffs and provided Murchison-Allman with Allman's clothing. She asked for her own clothes and to use the bathroom, but her requests were denied. The Plaintiffs were re-handcuffed and brought to a van with other people and eventually brought to the 41st Precinct and they were held in custody for over 30 hours. \n\nThe search was executed pursuant to a search warrant based on a drug investigation falsified by officers Adames, DiSimone, Ramos, and McMann with information that did not match the Plaintiffs' descriptions. The officers only recovered a box of old ammunition that belonged to one of the Plaintiff’s ex-boyfriends and a small amount of marijuana. The defendant officers found plaintiff Gonzalez in his room and placed tight handcuffs on his wrists. Gonzalez repeatedly asked that his handcuffs be loosened, and the defendants ignored the request. The officers grabbed plaintiff Arce, brought him into the living room of his apartment and placed handcuffs on him. The defendants searched the plaintiffs as well as their apartments and unlawfully took and withheld approximately $2,100.00 from plaintiff Colon and approximately $1,000.00 from plaintiff Arce. The defendant officers arrested the plaintiffs despite lacking any reason to believe they possessed any contraband or had committed any crimes or offenses. Plaintiffs were placed into a police vehicle, and while at the stationhouse, an officer subjected plaintiff Walters to an unlawful strip search where he was compelled to remove all of his clothing and asked to squat and cough.
