Plaintiff saw an Margarte Rivera, an acquaintance standing at a payphone the sidewalk, and Rivera wasn't feeling well. Plaintiff tried to convince Rivera to come home and sober up, but Rivera got mad and started hitting plaintiff with the payphone on his hands and chin, injuring Plaintiff. Defendants, the NYPD drove by and Plaintiff waived down the NYPD for help. the NYPD stopped in front of them and an NYPD officer exited his car and saw Plaintiff's injuries. Plaintiff told the officers about Rivera's drug addition and that Rivera was high. Plaintiff showed the NYPD officer a prior police report of Rivera when Rivera was high, suicidal and diagnosed with bipolar disorder. The officer spoke to Rivera who was high and could barely speak and said that Plaintiff was harassing her. The officers then knowingly and intentionally falsely arrested Plaintiff without any probable cause. Plaintiff was taken to the 42nd precinct and was fingerprinted, photographed and detained in a holding cell. The officers acknowledged that Plaintiff had injuries and had an ambulance come which took Plaintiff to North Central Bronx Hospital for treatment. Once he was treated, he was taken back to the 42nd precinct. Defendants maliciously initiated a prosecution against Plaintiff without probable cause and told the Bronx District Attorney's Office that Plaintiff did a crime even though they knew he didn't do any crimes. Based on this information, a prosecution against Plaintiff was started and Plaintiff was taken to the Bronx Central Booking. After 24 hours of policy custody, on September 8, 2013 Plaintiff was arraigned in Bronx Criminal Court and charged with crimes and bail was set at 15,000. Plaintiff couldn't post bail and was taken to the AMKC Facility at Riker's Island. On September 12, 2013 after spending 5 days at Rikers, Plaintiff was released with all felony charges dismissed.
