The incident took place in Far Rockaway. Plaintiff tried to calm K.N. until officers arrived. Four officers, Jane and John Doe1-3 and Officer Nicholas Piarulli entered their home. Officers spoke separately to Castillo and K.N., and were joined by more officers during the interaction. Both Plaintiffs indicated that no one was injured. However, the defendant officers arrested them both without explanation, stating it was a grey area. This arrest was racially motivated as Plaintiffs are Hispanic. At around 9: 30 am, both Plaintiffs were arrested and taken to the 100th Precinct. At the precinct, Mr Castillo and his son were separately processed and were held in cells for about 12 hours without being informed of the crimes he was being charged for. Saturday night, around 9 pm K.N. was taken by NYPD officers to criminal court youth part in Manhattan and then to a facility called 16 in Manhattan.  There K.N. was beaten by other teenagers. He was released early Sunday and was told he cannot go home. He stayed with family friends. Meanwhile, around 10 p.m. on Saturday, Mr. Castillo was taken to court and held at a cell near the courtroom.  Around 12:30 a.m. Sunday morning Mr. Castillo was brought to stand in front of the Judge.  An order of protection preventing contact with K.N. was issued and Mr. Castillo was released without his belongings around 1:30 a.m. Upon returning home, he learned K.N. was at a children's facility but could not communicate due to the court order. At a child safety conference, Mr. Castillo was informed of charges against him. Charges against Mr. Castillo were dismissed on February 24, 2022, and K.N. returned home.
