Zuccotti Park was during that time period a hub of activity for the Occupy Wall Street (OWS) Movement. Plaintiff had been an active participant in the OWS movement, but on this night (St. Patrick's Day), she went to the park with a friend. Police began to violently arrest numerous people in and around the park. As plaintiff was exiting the park, defendant officer Bovell- without identifying himself as a police officer- came up behind plaintiff, reached around her, grabbed her breast, and pulled her backwards. In this course of this incident, plaintiff's elbow had struck Defendant officer Bovell in the face. Plaintiff was then violently assaulted with excessive force by defendant officers of the NYPD. During the course of the assault, Plaintiff had suffered a severe blow or blows to her head which had caused her to black out for a short period of time. Plaintiff has no memory of striking defendant officer with her elbow. Plaintiff was taken onto a bus which was used to transport arrestees. While on the bus, Plaintiff suffered a seizure due to the assault she had sustained. While plaintiff continued to seize, defendant officers stood around and did nothing. People at the scene had informed the officers that they were licensed EMT's, but the officers (including officer Waring) did not allow these EMTs to render medical care. After a substantial amount of time, an ambulance arrived and administered medical care to plaintiff. Plaintiff was taken to Downtown Hospital where she remained in police custody. From there, plaintiff was taken to the Midtown South Precinct, where her cellmates complained to the police staff present that plaintiff was passing in and out of consciousness. She was then taken to Bellevue Hospital Center in police custody, then subsequently released back into NYPD custody and then eventually arraigned and released from custody. Defendant Waring is the deponent on the complaint that was lodged against plaintiff that states plaintiff had approached Defendant bevel and struck his face with her elbow, causing defendant officer to suffer swelling and bruising in his left eye. The allegations are false. On November 12, 2011, plaintiff was again participating in an Occupy Wall Street demonstration, when PO John Doe grabbed him and arrested him without probable cause. He was held at One Police Plaza for 10 hours before being released with a summons.
