NYPD Officer Thomas Costarella and Sergeant Michael Szczecinski responded to a 911 call reporting the assault; when they arrived at the scene, they advised Plaintiff to go to the hospital, but Plaintiff did not want to go. The officers then grabbed Plaintiff’s arm and slammed his head into the ground. The officers proceeded to question, frisk, search, and arrest Plaintiff, who was not resisting. \n\nPlaintiff was taken to the 61st Precinct against his will, where he was placed in a holding cell. After being examined by EMS at the precinct, Plaintiff was taken to the hospital for treatment of his injuries, where he was handcuffed to a gurney for several hours. After undergoing medical examination and treatment, Plaintiff was taken back to the 61st Precinct and again placed in a holding cell again before being transported to Brooklyn Central Booking. Plaintiff was charged with disorderly conduct, harassment in the second degree, obstruction of governmental administration in the second degree, and resisting arrest. \n\nOn September 25, 2016, Plaintiff was arraigned and released after being detained for approximately 24 hours.
