As traffic built up, Plaintiff pulled the car forward to the curb by a fire hydrant with the motor running. Defendants Ciccolo and Doe 1&2 approached and ordered the Plaintiff out of his vehicle. Two officers interviewed the Plaintiff and one searched the vehicle. One of the officers placed a substance into Plaintiff's pocket, removed same from his pocket, and cuffed the Plaintiff. Plaintiff was falsely imprisoned at both the scene of the occurrence and continuing thereafter at the 25th Precinct and Central Booking and Criminal Court. Plaintiff was not released until approximately 9pm, April 27, 2014. As a result of the aforementioned, Plaintiff suffered emotional trauma, feared for his life, sustained other consequential damages. Plaintiff had taken his niece to the park. Officers drove by and questioned plaintiff why he was inside the park and whose scooter was near the bench. Plaintiff explained it was his niece's and she was in the store buying ice cream with a neighborhood friend. Officers did not believe plaintiffs explanation, pointed to an unknown object under the bench where plaintiff was seated, and told him they now had probable cause to search him. Officers ordered plaintiff to stand, and they searched him. They found pepper spray attached to the plaintiffs key chain. Plaintiff advised he had it for defensive purposes, in case he gets jumped. Officers handcuffed and arrested plaintiff. Plaintiff was placed in a patrol car in front of his niece and neighbors, and transported to the 25th pct. where he was placed in a holding cell. Later that day, plaintiff was released with a DAT. Plaintiff was charged with crimes of unlawful possession of selling a noxious material, and possession of tear gas. The NYS DoE was notified of the plaintiff's arrest. Plaintiff was required to make multiple court appearances.
