The Officers removed Plaintiff to the precinct, where he was placed in a holding cell. Plaintiff requested medical attention, informing the officers that he was 71-years-old and had recently undergone open-heart surgery and five bypasses. Officers told plaintiff he would be given a Desk Appearance Ticket and released within an hour. Instead, after several hours Plaintiff was interrogated without being read his Miranda Rights and without an attorney present, despite clearly asking for one twice. Later that day, Plaintiff was moved to Central Booking, where his requests for medical assistance continued to be ignored. \nEventually, Plaintiff was moved to a hospital for medical treatment. The next day, May 12, 2022, after being released from the hospital, he was again taken to Central Booking. When Plaintiff realized he would spend another night in custody, he began to experience chest pain and high blood pressure, and was again moved to a hospital for treatment before being brought back to Central Booking on May 13, 2022. During the transfers, Plaintiff was tightly shackled, causing injury including an infected laceration that resulted in a permanent scar. While Plaintiff was in custody, defendant Officers falsely told the Richmond County DA's Office that Plaintiff committed the crime of criminal mischief: intent to damage property, on the property that Plaintiff owned. On May 13, 2022, Plaintiff was arraigned and released.
