They were approached by defendants, who ordered them to line up against a wall. Three police vehicles approached. There were six officers at the scene, including two officers attired in white shirts. A white female and her husband arrived. The female's husband threatened plaintiff and acquaintances in the presence of the defendants, stating he would shoot them if he saw them in his neighborhood again. The female walked up and down the line, observing plaintiff and acquaintances. As the female passed each of the men lined up against the wall, the men, including plaintiff were directed by defendants to step forward, remove their hats, and smile. The female was unable to identify plaintiff or acquaintances as the perpetrator of an offense. After the female inspected plaintiff and acquaintances, one officer exclaimed \"Let's go! Pick someone, anyone, or else we'll have to leave. It's getting to be like a circus\". The female said \"all right, I'll pick that one\", pointing to plaintiff. Plaintiff was arrested and taken to a police precinct where he was \"processed\". Plaintiff was transported to New York Central Booking. On October 11, 2011, plaintiff was arraigned. Plaintiff pled \"not guilty\" and was released on his own recognizance. Plaintiff returned to criminal court each month.
