They had a warrant based on a tip from a confidential informant that crack cocaine had been sold by Ms. McClain's brother in the apartment. Ms. McClain's brother did not live in the apartment, nor did he ever live there or have keys, and only visited every few weeks. Ms. McClain, wearing only undergarments at the time, was pushed into a chair and handcuffed with excessive tightness. Her mother and six-year-old son were in another part of the apartment, told to \"get the fuck down on the floor\" at gunpoint, and Ms. McClain was not allowed to see them. Their requests to use the bathroom were denied. The apartment was ransacked and property damaged. After about a half hour, Ms. McClain requested proper clothing; and despite her wishes for her mother to assist in putting them on, a male officer dressed her. Her requests to loosen the handcuffs were ignored, causing swelling the day after. Ms. McClain was brought to the precinct against her will, and her mother and son were told to vacate the apartment for them to search it further. When they returned the door was off its hinges and the apartment left completely unsecured for anyone to enter. At the precinct, Ms. McClain was searched by a female officer in an obtrusive manner. She was held in a cell in the precinct the entire day and transferred to Booking overnight where she was held overnight until arraignment. \n\nOfficer Demchenko was the deponent of the criminal complaint against Ms. McClain which falsely alleged that the officers found drugs in the apartment and that Ms. McClain had admitted to smoking weed. Officer Allen falsely averred in an Affidavit of Inventory of Property Taken that various narcotics in NYPD custody were recovered via the search. Defendant walked to Plaintiff's car and asked Plaintiff to role down the window and asked if the car belonged to Plaintiff. Plaintiff said yes and Defendant asked for Plaintiff's license. Plaintiff asked what she did wrong and Defendant told Plaintiff to stay there. Defendants Papallo and Defendant NYPD Officer John Casazza approached Plaintiff's car and Casazza told Plaintiff to roll down her window which Plaintiff did. Cassazza then lunged through the window and took Plaintiff's pocketbook off the passenger seat. Plaintiff grabbed onto the pocketbook and Casazza latched onto Plaintiff's arm and began pulling and twisting it. Plaintiff was scared and called 911, and then Casazza gripped the top of the glass of the window and put his face into the window and bared his teeth at plaintiff. Plaintiff told the 911 operator about what happened and asked the operator what to do. The operator said she didn't know what to do and Plaintiff then cried and the operator said she would send help. Then a police car came at the scene and 2 police officers got out, Defendant Doe and Defendant LT. William Taylor, and then Casazza released his grip from the passenger window of Plaintiff's car and went to defendant Taylor to speak with him. Defendants then came to driver side window of Plaintiff's car. Taylor had his nightstick and was beating his hand in a threatening manner and told Plaintiff to roll down her window and told plaintiff to get off the phone and step out of the car. Plaintiff asked what she did wrong and Taylor refused to answer. Defendant Taylor punched Plaintiff in the chest, grabbed her by her shirt and violently began trying to pull Plaintiff out of the window of the car. Defendants then started to pull Plaintiff out of the vehicle. One officer unlatched Plaintiff's seatbelt. Defendants pushed Plaintiff's body and pulled her out of the car, threw her body on to the ground and handcuffed her. One defendant drove off in Plaintiff's car. The Defendants threw Plaintiff against a car, illegally searched her and threw her into the back of a police car and took her into custody. Defendants detained, seized and arrested Plaintiff without probable cause, and searched Plaintiff's person and possessions and belongings, and her car, including the glove compartment and trunk. Defendants used more force than reasonably necessary to take Plaintiff into custody. Plaintiff was taken to a precinct and was photographed, fingerprinted and handcuffed to a rail or confined to a cell for approximately 6 hours. At the precinct Defendants mocked plaintiff and humiliated her. After 6 hours, Plaintiff was taken to Bronx Central Booking and other facilities for approximately 3 days. Defendants also gave false allegations against Plaintiff to the Bronx County District Attorney and charged Plaintiff with other  charges. Plaintiff was arraigned and plead not guilty to all counts and was released. Plaintiff had to come to court on several occasions until April 8, 2014 when the charges were dismissed. Eventually, NYPD officers directed Plaintiff and others to follow a police officer down a street. The police then took out orange mesh rope known as kettling nets and arrested a group of people they had led down the street, without individualized probable cause. Plaintiff was placed in tight plastic handcuffs that caused her hands to go numb. When the officers cut the cuffs off of her, they also cut her skin. She asked for medical attention, but the police told her it would slow down her release. Plaintiff was held for approximately 21 hours before she was released at her arraignment. \n\nUpon information and belief at the time of the complaint, former Commissioner Raymond Kelly had given police officers orders to arrest people regardless of probable cause, and not to release them from the precinct. POs William Gardner, William Taylor, and Brian Thompson were also involved in the unlawful actions against Plaintiff.
