Plaintiff lived in a different building in the complex.   Plaintiff was stopped without probable cause by Defendant NYPD Officers Gregory Lomangino, Joseph Koch and Sergeant James Geissler, which officers had previously repeatedly stopped and harassed him in an effort to make Plaintiff move from the complex.  Those officers had even visited Plaintiff’s apartment to force him to move out in part because Plaintiff relied on Section 8 vouchers.  \nAlthough the Officers knew Plaintiff lived in another building in the complex they asked Plaintiff if he was a resident.  Plaintiff stated he had a legitimate purpose for visiting his grandmother and had been buzzed into the building by her.  Despite this legitimate reason, the Officers searched Plaintiff, placed him under arrest for trespassing, and transported him to a precinct.  The Officer made false statements about whether he was an invited guest based on the tenant list and an affidavit from the building manager, but no tenant list was ever provided to the District Attorney or attached to the affidavit.  Defendant Lomangino signed a false criminal complaint that was the basis for an arrest.
