Without cause, Defendant Officer Schumacher tackled Plaintiff into a hot metal grill using full weight of Defendant's body and landing on top of the Plaintiff, causing severe burns to his body, and continued to batter him on the concrete sidewalk by landing his body weight on Plaintiff and placing his knee on Plaintiff's chest and used both of Defendant's hands to shove Plaintiff's face and head into the concrete sidewalk.. The officers searched Davis without authority and left him injured without arresting him. Defendant Officer Schumacher was joined by Defendant NYPD Detective Teanesha Jackson who was also assigned to NYPD CRT. Defendant Jackson placed her body weight on Plaintiff's back and chest and assisted Defendant Schumacher in twisting the Plaintiff's arms behind his back, causing more pain to Plaintiff's injuries. Another CRT member, believed to be Defendant NYPD Detective Alex Mills further assisted the other Defendants by placing additional weight on these Defendants. Defendants proceeded to search Plaintiff's person and property without justification or cause, and left him injured without arresting him. The police officers entered his building and detained him while accusing him of purchasing narcotics. The police then searched the vehicle and held up an empty plastic bag, and said \"cuff him.\"  The officers drove Pierre around for 6 hours and took him to both the 120th and 122nd precincts, where he was fingerprinted and searched multiple times. He was not processed until 3:00AM the next day. The defendants knew they did not have probably cause to arrest Pierre and that he committed no crimes. He was released on August 31, 2017 without going before a judge and he received a letter from the Richmond County DA's Office that the prosecution had been declined. Without a warrant and without probable cause or reasonable suspicion to believe that Plaintiff had committed a crime, the Defendants-officers forcibly detained Plaintiff and searched Plaintiff and his vehicle without Plaintiff's consent. After conducting the search, the Defendants-officers forcibly placed Plaintiff in handcuffs and imprisoned him against his will at various locations, including a police precinct and Central Booking. On or about December 20, 2014, Defendant Stefopoulous, in concert with Defendants Friedman and Truscelli, signed an accusatory instrument charging Plaintiff with several counts of criminal possession of a controlled substance, of which Defendant Stefopolous knowingly dd not have probable cause to charge Plaintiff. On or about June 24, 2015, all criminal charges against Plaintiff were dismissed and the criminal proceeding was terminated favorably to Plaintiff.
