The car followed him, and when Plaintiff was at his aunt’s door, three men, two with guns pointing at him, approached Plaintiff. Terrified for his life, Plaintiff placed his hands in the air. It turned out that the men were police officers. Officers tackled Plaintiff to the ground, dragged him, and punched him in his ribs, neck and the back of the head. One of the officers stomped Plaintiff’s head into the concrete rendering him unconscious. \n\nWhen Plaintiff regained consciousness, he was in handcuffs on the curb. The officers then asked him where the drugs were and one of the officers told Plaintiff “You going to run from a white person?”. More police cars were called to the scene. The police searched the area for weapons and contraband, and did not find any. Nonetheless, officers arrested Plaintiff without legal basis. At the precinct, he was strip-searched and issued a Desk Appearance Ticket. P.O. Quinto maliciously provided false information to the DA’s Office. On May 23, 2013, the ticket was dismissed for being legally insufficient.
